Judicial Review Zoning Variances Licenses Claims for Damages Limitation Periods
Our Services
  Judicial Review

Municipal decisions may be quickly challenged and heard by Petition brought under the Judicial Review Procedure Act.

The application can be heard by the court within several weeks of filing.
    Evidence is presented by affidavit.
The Court can order an official to take a specific action such as to approve a subdivision or to issue a permit or it can direct him to reconsider.
The Court can be asked to interpret the meaning of bylaws and resolutions.
There is no time limit for bringing an application but a judge may nevertheless refuse to grant relief if there is another course of appeal that has a short limitation period.
